STATEMENT OF CLAIM:
FINDINGS:
AWARD N0. 109
CASE NO. None
(BU 7991-33)'
SPECIAL BOARD OF ADJUSTMENT NO. 355
THE ORDER OF RAILROAD TELEGRAPHERS
THE BALTIMORE AND OHIO RAILROAD COMPANY
AWARD IN DOCKET NO. 109
Carrier violated the Agreement between the parties when it failed to
call C. A. Groff, Agent-Operator at Creekside, Pennsylvania, to perform work on his assigned rest day, Sunday, February 12, 1961.
Carrier shall be required to compensate C. A. Groff in the amount of
four hours' pay at the time and one-half rate.
The 7:00 a.m. -- 3:00 p.m. period at Creekside on Sundays is not a part of
any assignment.
Carrier was, therefore, correct in following Article 23(m) and calling the
available extra man who had not completed 40 hours of work that week to work
there on the Sunday in question.
