1. Carrier violated the Agreement between the parties when on January 14,
1961 it required or permitted train service employes, not covered by
the Agreement, to perform the work of the operators at-Lester, Ohio
while the operators were idle on rest. days.
2. Carrier shall be required to compensate W. W. Knapp, G. Emerson and
D. M. McCoy each in the amount of a day'-s pay (eight hours) on January
14, 1961.
FINDINGS:
Organization relies on our Award in Docket No. 45 where the position of the
Organization was sustained. We disagree.
The work here involved is the throwing of ground switches. The same issue
between this Organization and the Pennsylvania Railroad came before the Third
Division, National Railroad Adjustment Board in Docket No. 8421. We will follow
that. Award.
