STATEMENT
OF CLAIM:
1,. Carrier violated the Agreement between the parties when on
October 9, 13, 149 15, 16, 30 and 31, 1959, it required or
permitted the General Yardmasters at Brunswick, Maryland, not
covered by said Agreement, to use the telephone to communicate
directly with the Train Dispatcher, transmitting and/or receiving information in connection with the movement of trains.
2. Carrier shall be required to compensate an operator in the
amount of a day°s pay (8 hours) on each day of violation as
follows: A. J. Hiers on October 9 and 30, F. V. Grimes do
October 13, C. F. Selby on October 14 and 15,
W.
H. Francis
on October 16, A. R. Marks on October 31, 1959.
FINDINGS:
An officer of this Carrier -- a General Yardmaster -- on certain dates
used the telephone to speak with a Train Dispatcher to seek information on trains
and the movement of trains he felt he required in the discharge of his duties as
a General Yardmaster.
The Organization concedes that the information he sought was information that might have already gone or eventually goes through channels, via
operators where required by the Rules Agreement.
It was not a rules violation. We have already so held in Award No. 71.
