AWARD N0. 116
CASE NO. NONE
(BU 6807-33)

SPECIAL BOARD OF ADJUSTMENT N0. 355

Parties:

THE ORDER OF RAILROAD TELEGRAPHERS
THE BALTIMORE AND OHIO RAILROAD COMPANY

AWARD IN DOCKET N0. 116

STATEMENT OF CLAIM:

FINDINGS:

An officer of this Carrier -- a General Yardmaster -- on certain dates used the telephone to speak with a Train Dispatcher to seek information on trains and the movement of trains he felt he required in the discharge of his duties as a General Yardmaster.

The Organization concedes that the information he sought was information that might have already gone or eventually goes through channels, via operators where required by the Rules Agreement.

It was not a rules violation. We have already so held in Award No. 71.
