STATEMENT
OF CLAIM: 1. Carrier violated the Agreement between the parties
  
when on March 4, 1960 it required or permitted an
  
employe not covered by said Agreement at Cowen,-. West
  
Virginia to transmit by use of telephone a message
  
to the train dispatcher.
2. Carrier shall be required to compensate Operator
 
I. C. Sandy in the amount of a day's pay (eight
 
hours) on March 4, 1960.
FINDINGS:
We are here concerned with the same type of information we had before
us in Docket No. 34. It was advance information to the Train Dispatcher as to
the loading at Cowen.
As we held in Docket No. 34, we will hold here that the conversation
was one between employees and the dispatcher which was necessary in the performance of the work of these people; clearly they were not blocking trains, handling
train orders or messages of record.
