1. Carrier violated the agreement between the parties when
on January 13 and on January 19, 1960, it required or
permitted a Diesel Maintainer, not covered by said Agreement, to use the telephone to communicate directly with
the train dispatcher.
2. Carrier shall be required to compensate E. C. Market,
Agent-Operator at Montezuma , in the amount of a minimum
call payment (2 hours at the time and one-half rate) on
each date set forth above.
The claim here involves information required by a Diesel Maintainer on
approaching trains; the same type of claim we had before us in Docket No. 58.
