AWARD IN DOCKET NO. 125

STATEMENT OF-CLAIM:

        1. Carrier violated the Agreement between the parties

        when on May 13, 27, 28, June 3. 10, 13, 27, 30, 1958,

        it required or permitted the employees not covered by

        the Agreement to copy track car lineups (Form 1089mD)

        at or near HK Tower, Pa.


        2. Carrier shall compensate an idle operator in the

        amount of a day°s pay (8 hours) on each of the dates

        set forth above.


FINDINGS:

Organization here predicates its claims on its assertion that the track car lineups were copied "at or near HK Tower."

However, Victoria is the site of a former station carried in the timetable as recently as April 25, 1937. The lineups having been copied at points east of Victoria, then, intervenes between HK Tower and the points at which the lineups were copied. It follows, then, that the points at which the lineups were copied do not lie within the station limits of HK Tower and a denial award is required.
