SPECIAL BOARD OF ADJUSTMENT N0. 355

Parties:

STATEMENT OF CLAIM:

FINDINGS;

AWARD N0. 126 CASE N0. 138 BU-5836

THE ORDER OF RAILROAD TELEGRAPHERS

THE BALTIMORE AND OHIO RAILROAD COMPANY

AWARD IN DOCKET N0. 126

1. Carrier violated the Agreement between the parties when
on March 12, 17, 18, 198 21 and 25, 1958, it required or
permitted employes not covered by the Agreement to copy
track car lineups (Form 1089-D) at Mile Post 6 (CW Cabin),
Ohio.

2. Carrier shall compensate an idle operator in the
amount of a day's pay (8 hours) on each of the dates set
forth above.

Carrier's defense here is predicated on its assertion that Anderson's Ferry intervenes between the points at which the lineups were copied and CW Cabin; hence, in Carrier's view they were not copied within the station limits of CW Cabin.

Anderson's Ferry does not show as a station in any of Carrier's timetables. It is a geographic location. This claim is, thus, distinguished from that in Docket No. 125, and a sustaining award will be made.
