1. Carrier violated the Agreement between the parties when on August.29,
30, September.3, 4, 5, 6, 9, 10, 11, 12, 16, 17, 18, 19, 20, 23, 24,
25, 26,'27, 1957 and subsequent dates the track foreman at Lynchburg,
Ohio, secured his track car lineups via telephone from the operator at
Blanchester or New Vienna or through a Maintenance of Way employe.
2. Carrier shall compensate an idle operator in the amount of a day's pay
(8 hours) on each date such violations occur.
With respect to the'Organization's'claim of violation on August 29 and 30,
and September 3, 4, 5, 6, 9, 10, 11, 12, and 13, 1957, these claims have already
been paid by the Carrier.
Wabth respect to the claims for September 16, 17, 18, 19, 20, 23, 24, 25, 26
and 27, 1957 when a trackman personally received the lineups from the operator we
will follow our Award in Docket 33/11 and issue a denial award.
Claim denied.
