1. Carrier violated the agreement between the parties when
on October 1, 19, 22, 1959, it required or permitted employes
not covered by said Agreement to use the telephone at Okonoko,
West Virginia, to secure permission to use track No. 1 (also
OS a train on October 19).
2. Carrier shall be required to compensate an idle operator
in the amount of a day's pay (8 hours) on teach of the dates
set forth above.
We have carefully reviewed the Carrier's Argument and are not persuaded
that the issue here involved is any different than that previously before this
Board in Dockets 7, 9 and others. The fact the use of a pushbutton is involved
does not alter the purpose for which the calls were made.
