SPECIAL BOARD OF ADJUSTMENT N0. 355
Parties: THE ORDER OF RAILROAD TELEGRAPHERS
THE BALTIMORE AND OHIO RAILROAD COMPANY
AWARD IN DOCKET N0. 142
STATEMENT
OF CLAIM:
FINDINGS:
AWARD N0. 142
CASE N0. None
BU-8003-33
Carrier violated the Agreement between the parties when
it required and permitted a train supervisor at Decatur,
Illinois, and a track foreman at Tuscola, Illinois, to
use the telephone for communication regarding the movement of a car.
Carrier shall be required to compensate Operator C. E.
Alexander in the amount of a day's pay (8 hours) on
February 1, 1960.
It is argued in behalf of the Carrier that the scrap car in question
did not move as a result of the telephone conversation in question; it would
have been necessary for the supervisor to arrange with the agent to move the
car.
