STATEMENT
OF CLAIM:
1. Carrier violated the Agreement between the parties when it required
or permitted Conductors of maintenance work trains to report clear of and se
cure permission to use No. I track at Lansdowne on June 21, 25, 26, 27, 28, 29
and 30, 1958.
2. Carrier shall compensate an idle operator on each date in the amount
of a day's pay (8 hours): J. S. Dixon June 21; L. M. Harper on June 25; W.
Boyer on June 26; H. D. Coldfelter on June 27; L. A. Goad on June 28; J. E.
Henson on June 29; R. 0. Swearingen on June 30.
FINDINGS:
For the reasons set forth in our Award in Docket No. 15, we will hold that
the call made from Lansdowne was permissible under revised Article 35.
