THE BALTIMORE AND OHIO RAILROAD COMPANY
STATEMENT
OF CLAIM:
1. Carrier violated the Agreement between the parties when it required
or permitted a conductor on a work train engaged in maintenance service to re
ceive and copy train order No. 71 at James, Indiana on May 9, 1957.
2. Carrier shall compensate an idle operator in the amount of a day°s
pay (8 hours) on this date.
FINDINGS:
This is another "station limits" claim.
So far as the factual record is concerned James, Indiana is .6 mile west of
North Vernon.
Organization concedes North Vernon is a "station" insofar as Article 35 is
concerned. Carrier states James is the name of a siding and it is definitely
within the "station limits" of North Vernon, being .6 mile distant. Organization says it is not.
