STATEEZENT 1. Carrier violated the Agreement between the parties
OF CLAIM: when it required or permitted an employee not
covered by the Agreement to report a passing train
at Dei?iance, Ohio on August 7, 1961.
2. Carrier shall compensate D. L. Vandcrbosch in the
amount of a call payment on August 7, 1961.
FINDINGS: We cannot sustain a claim against this Carrier be
cause a clerk, of his own motion, telephoned the
operator at Sherwood to report that a train was
just then going by Sherwood.
