STATEEZENT 1. Carrier violated the Agreement between the parties
OF CLAIM: when it required or permitted an employee not
covered by the Agreement to report

passing train
at Dei?iance, Ohio on August 7, 1961.
2. Carrier shall compensate D. L. Vandcrbosch in the
amount of a call payment on August 7, 1961.
FINDINGS: We cannot sustain a claim against this Carrier be
cause a clerk,
of
his own motion, telephoned the
operator at Sherwood to report that a train was
just then going by Sherwood.
