STATEMENT 1 - Carrier violated the Agreement between
OF CLAIM: the parties when on May 24, 1960 it re
quired or permitted employees outside
the Agreement to communicate direct with
the Train DZspatcher at Swanders, Ohio.
2 - Carrier shall compensate Operator W. V.
' Hettesheimer in the amount of a day's
pay (S hours) on May 24, 1960.
FINDINGS:
Because we believe that the setting out of a
car from one train -- because of shifted cargo
-- to be subsequently picked up by a local
train for delivery to the next terminal, would
have to become a matter of record, we will
follow our Award in Docket No. 66 and sustain
this claim.
