AWARD IN DOC=T PTO. 235
STATEMENT 1. Carrier violates and continues to violate the
OF CLAIM= Agreement between the parties when if fails and
refuses to compensate the agont-operator, second
trick operator and third trios operator at Deshler,
Ohio, as provided for in Articles 25 and 32.
2, Carrier shall compensate the occupants of the agent.
operator position, second and third trick opera';or
positions in the amount of $1.00 each day they rrre
required to work in another office not located in
the same building with their regular assignments and
to adjust the rate of the second and third trick
operator positions to that of the agent-operator,
effective March 22, 1962.
FINDINGS;. A review of this record leads us to find that Carrier
is required to comply with the provisions of Article
25 (a) on each day that claimants are required by the
Carrier to perform any duties in the tower building.
We will, however, deny the claim for adjustment of
the rate of the two operator positions to that of
agent-operator for alleged violationcf Article 32.
When the three operator positions were moved from
the tower building to the passenger station, the
incumbents thereof were assigned to the passenger
station, and they were not thereafter "compelled to
work a partial time" in more than one of two or more
offices.
