CASE N0.104
(BU-5802-33)
SPECIAL BOARD OF ADJUSTMENT N0. 355
THE ORDER OF RAILROAD TELEGRAPHERS
THE BALTIMORE AND OHIO RAILROAD COMPANY
Parties:
AWARD IN DOCKET NO. 47
STATEMENT
OF CLAIM:
1. Carrier violated the Agreement between the parties when on
March 31, 1959, it required or permitted an employe not
covered by the Agreement at Harris Ferry, West Virginia, to
communicate direct with the train dispatcher and exchange
information concerning the movement of trains.
2. Carrier shall compensate an idle operator in the amount of a
day's pay (eight hours) on March 31, 1959.
FINDINGS:
An examination of the agreed facts leads us to conclude that the
information involved in the telephone conversation would have been a matter
of record, and, therefore, a sustaining award is in order.
Claim sustained.
