STATEMENT
OF CLAIM:
1. Carrier violated the Agreement between the parties hereto when
on April 20, 1957, it caused, required and permitted Yardmaster
Miller, an employe not covered by the Telegraphers' Agreement,
at North Lima, Ohio to report directly to the train dispatcher
at Deshler, Ohio over the dispatcher's telephone the time light
engine 209 passed the yard office, which work was and
is
reserved
solely to employes covered by the Telegraphers' Agreement.
2. Carrier be required to compensate an idle operator, extra in
preference, pay for one day (8 hours) because of said violation.
FINDINGS:
The conversation involved in this claim is similar to those involved in
our Awards in Dockets Nos. 52 and 53, and for the reasons there cited, will be
denied.
