STATEMENT
OF, CLAIM:
1. Carrier violated the Agreement between the parties hereto when on
November 7, 1957, and subsequent dates, it caused, required and
permitted Conductor Kerner on 2d 64, an employe not covered by the
Telegraphers' Agreement, to communicate directly with the train dispatcher over the telephone from Louisville, Kentucky, on information
of record concerning the movement of his train from Louisville,
which work was and is reserved solely to employes covered by the
Telegraphers' Agreement.
Carrier be required to pay an idle operator, extra in preference,
pay for one day on November 7, 1957 and all subsequent dates on
which similar violations occur at Louisville.
FINDINGS:
The locale of this claim is the Illinois Central Railroad's Central Union
Station at Louisville, Kentucky. It is not on or near the property of this Carrier; nor was there ever a B & 0 Operator at this point.
Irrespective of the merit of the claim, or lack of merit, we can find no
basis for
considering it
