STATEMENT
OF CLAIM:
1. Carrier violated the Agreement between the parties when on February 14,
1959, it required an employe not covered by the Agreement at Leo
Street Yard Office, Dayton, Ohio, to communicate direct with the train
dispatcher at Deshler, and exchange information concerning the movement of trains.
2. Carrier shall compensate Operator J. A. McDaniel in the amount of a
day's pay (8 hours) on February 14, 1959.
FINDINGS:
The type of conversation here involved is similar to that involved in prior
dockets which we held to be permissible, and not a violation of the Agreement.
