THE BALTIMORE AND OHIO RAILROAD COMPANY
AWARD IN DOCKET N0. 82

STATEMENT OF CLAIM:

        1. Carrier violated the Agreement between the parties when on March 30, 1959, it required or permitted an employe not covered by the Agreement to use the telephone at Indian Creek, Pennsylvania, to secure permission to enter and report clear of No. 1 track.


        2. Carrier shall compensate Operator W. J. Ryan in the amount of one day's pay (8 hours) on March 30, 1959.


FINDINGS:

We will follow our Awards in Dockets Nos. 80 and 81 and deny this claim for the reasons set forth in our Award in Docket No. 80.
