"Claim of the System Co=t tee of the Brotherhood that:
(a) The Carrier violated the Clerks' Rules Agreement, effective 'by
1, 1942, except as amended, particularly the Scope and Rule.2-A-1, when it
failed to advertise a position in the Office of Auditor of Expenditures,
Comptroller's Department, Philadelphia, Pa., and assigned the work to J. J.
Agnew, who held a position designated as 'Special Duty'.

(b) Paul A. Dougherty, compensated for the difference
between his own rate of pay and the rate of pay of J. J. Agnew, Clerk, be
binning October 8, 1956, and until adjusted, as a penalty."
FINDINGS
:
We have reviewed this reccrd carefully particularly the responsibilities
and functions of the Methods and Procedures Department engaged in electronic
data processing.
We have also analyzed the advertised duties of the Machine Operator
position held by Claimant Paul A. Dougherty, as well as the assignment given
Agnew.
The conclusion that the work performed, and responsibilities held
by Agnew are not the same as those attaching to Dougherty's job, is inescapable. A denial award is in order.
