(a) The Carrier violated the Clerks' Rules Agreement, effective
May
1, 1942,
except as amended, particularly Rule It-A-1 (i), when it
assigned the duties of the position of Clerk E. P. Bakley to the
incumbent of a supervisory position on Saturday, April
20, 1957.
(b) The Claimant, .^·,. R. Bakley, be compensated for eight hours
pay, at the punitive date, for April
20, 1957."
FINDINGS:
It is very clear that the work performed by J. R. Klusman as
assistant lead clerk wqs in the category of his assigned duties.
His posit=on being excepted from only the advertising and displacement rules of the applicable agreement, it follows that the duties of his
position are fully covered by the scone rule of the agreement, and Claimant
could not - under suds circumstances - prove a violation.
AWARD:
Claim denied.
