STATEMENT OF CLAIM:
1. The Carrier violated the terms of the agreement between the parties
when on October 13th, 15th, 24th, November 2nd, 15th, 23rd, 30th,
December 12th, 22nd, 1960, and January 10th, 12th, 13th, 22nd, 23rd,
24th, and 25th, 1961, at "WB" Clearfield Yard, Pennsylvania, it required and permitted employes not coming under the Telegraphers
Agreement, by the use of the telephone, to handle communications of
record, "OS" trains, and perform Block Operators work.
2. The Carrier shall be required to compensate Extra Telegrapher C. D.
Stewart, one day's pay at the rate of $2.44 per hour for eight hours,
for each of said violations.
OPINION OF BOARD:
The evidence discloses that the communication activity here in dispute
occurred within yard limits and was handled in the subject manner in lieu of
messenger service. It therefore must be concluded that there is no valid basis
for the claim.
Claim denied.
