STATEMENT OF CLAIM:

Claim of the General Committee of The Order of Railroad Telegraphers on the New York Central, Eastern District, that:

          1. Carrier violated the Telegraphers' Agreement in abolishing telegraph service positions and transferring the work performed by such employes to the train dispatchers at Rochester, New York.


        2. Carrier shall compensate a day's pay of eight hours for each

          eight hour shift around the clock on each day commencing with _,

          August 12, 1957 and continuing until such violation is cor

          rected, to the senior idle extra employe on the following list:

          3. In the event the extra employes shown above or any other employes subsequently added to the list are working on any day, the Carrier shall compensate the senior idle regular assigned employe on his rest day for a day's pay.


OPINION OF THE BOARD:

In view of the Carrier's contention that the American Train Dispatchers Association is a party at interest in this dispute, notice of the pendency of this case was given to the Association. Copies of the ex-parte submissions of the above named parties were also sent to the Association. That organization replied, however, that it did not desire to participate in this proceeding.

This case is being remanded to the parties for joint consultation. If settlement of the dispute is not reached by August 1, 1963, the case may be returned to the Board upon the request of either party, in which case the Board will proceed to make a final determination.

Dear Sir:

In accordance with Award #21 of Special Board of Adjustment #421, a conference was held at Syracuse, New York on July 18, 1963 to discuss Case #21, the Rochester C.T.C. dispute.

At the conference, it was agreed that Case #21 would be disposed of in its entirety by the following:

    1. The Carrier will classify as "C.T.C. Operator" Telegraphic service positions in signal stations who operate C.T.C. machines.


    2. Shown below are specific positions in existing signal stations whose titles will be changed by the addition of the phrase "C .T .C. Operator°° thereto:


SS GS Syracuse director=leverman
SS TU Weehawken telegrapher-leverman
SS SR Jersey Shore wire chief
telegrapher-clerk
SS GY Geneva telegrapher-leverman
SS 47 Buffalo leverman
SS DV New York telephoner-leverman

    3. Prior to the extension of territory controlled by existing C.T.C. machines in signal stations or the installation of new C.T.C. machines in signal stations, the Carrier will confer with the General Chairman in accordance with the interpretation of question #3, N.M.B. Case A-2625=Arb 106.


    4. The rates of pay of certain positions at SS-47 and SS-DV will be subject to future negotiations.


        Please advise if this meets with your approval.
