STATEMENT OF CLAIM:
1. Carrier violated the provisions of the Telegraphers' Agreement when
it blanked the position of Assistant Agent and required an employe
not covered by the Agreement to perform the work of the Assistant
Agent at Oneida, N. Y. on February 22, 1961.
2. Because of the violation carrier shall pay a day's pay, eight (8)
hours, at the time and one-half rate of $3.714 an hour totalling
$29.712, to Assistant Agent John A. Manley for work denied on February
22, 1961.
OPINION OF BOARD:
The evidence discloses that work was performed on the subject holiday for
which the claimant, Assistant Agent John A. Manley, should have been called.
He is entitled to be compensated in the amount of a call under Article 5 (a) of
the agreement.
AWARD:
Claim sustained to the extent indicated in the above Opinion of Board.
