STATEMENT OF CLAIM:
1. Carrier violated the terms of the agreement between the parties when
it failed to call extra telegrapher W. H. Luce, who was first out on
the extra list, to cover extra work at "WK", Corning, N. Y., commencing 6:00 A. M., May 27, 1961.
2. Carrier shall compensate Extra Telegrapher W. H. Luce for 8 hours at
$2.494 per hour.
OPINION OF BOARD
Since extra telegrapher W. H. Luce was first out on the extra list to cover
8 hours of extra work at "WK", Corning, N. Y., commencing at 6:00 A. M. on
May 27, 1961 but was assigned instead to 8 hours of work on the same date at
Dresden, commencing at 3:00 P.M., we find that he is entitled to be compensated
in the amount of the difference in the rate of pay for the involved work at the
two locations. This conclusion is reached because of the claimant's status as
an extra employee at the time in question.
