OPINION OF BOARD:

AWARD N0. 5

CASE N0. 5

The evidence does not establish that the Carrier attempted to contact employes who were available and qualified to cover the subject. vacancy in the Freight Agent's position at Fonda, New York, instead of removing an employe from his regularly assigned position to cover this vacancy on each of.the two days involved (August 27 and 28, 1959). Accordingly, we will sustain part 1 of the claim. Parts 2 (c) and 2 (d) of the claim will be sustained for, employes J. S. Leggiero and M. Forman, but at straight time rate. Parts 2 (a) and 2 (b) of the claim will be denied.
