STATEMENT "Claim of the System Committee of the Brotherhood that:
 OF CLAIM:
 (1) The Carrier violated the effective Agreement by failing to pay Trackman D. B. Whetstone, Extra Gang Number 32222 of the former Newark Division, for holiday pay for New Year's day, January 2, 1961.

 (2) That claimant Trackman D. B. Whetstone will be now paid eight hours at his respective pro rata rate for this New Year's holiday referred to."

 FINDINGS: Our prior Awards in cases of this kind require that the claim
 in this docket be denied because the holiday involved was after December 29, 1960.

          Claim denied.
