STATEMENT "Claim of the System Committee that:
OF CLAIM:
(1) The Carrier violated the effective agreement by failing
to call Extra Gang Foreman George D. Bland, Extra Gang No.
36324, Toledo Division, for 11 hours of overtime work in the
Rossford Yard at Toledo commencing at 8:30 P.M. on Sunday,
April 16, 1961.
(2) That the carrier now compensate Extra Gang Foreman
George D. Bland for the 11 hours pay at his respective pro
rata rate."

FINDINGS: The facts indicated that the services of several trackmen
were needed because of (1) the snow storm which required
the installation of heaters in 32 cars of bananas and (2) the same storm
which required the lighting of heaters and the shoveling of snow so the
switches might work properly.

When Foreman Blasius filled the vacancy in his own gang and, under the circumstances then prevailing, still needed additional help he had a right to augment his own gang without having to call out the foreman under whom they normally are assigned.
