STATEMENT
OF CLAIM: "Claim of the System Committee of the Brotherhood that:
(1) The Carrier violated the effective agreement by
assigning employees of the signal department to the cleaning of snow
from switches at the interlocking plants at Heath and Outville, Ohio,
on December 21, 22, and 23, 1960.
(2) Trackman Brook Cornell be now compensated for three
days pay at his respective pro rata rate of pay account of this referredto violation of the Agreement."
FINDINGS: We can find no fault with Signal Department employees,
during their regular tour of duty and while a snow storm
was in progress, sweeping snow from switches at two interlocking plants.
To this extent this claim is distinguished from the circumstances of our Award in Docket No. 25.
