PARTIES: BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES

STATEMENT
OF CLAIM: The claim in dispute has been identified by the Organization
as follows:
"Claim of the System Committee that:
1. The Carrier violated the effective Agreement by assign-
ing to the Minot Wrecking and Salvage Company employes the dismantling of the
old sandhouse at Minot, North Dakota during the period May 1, to May 6, 1961.

2. That the members of B&B Crew No. 2, namely Foreman L. Jackson, First Class Carpenters C. Filipek, A. Salo, J. Score, and E. Herr, Second Class Carpenters M. Swan, C. Morrissey, I. Arneson and F. Rennie, Helpers G. Miller and H. Lorntson, Pipefitter A. Hanson and Truck Driver M. Bradley be now compensated for 18 hours pay each at their respective rates for their share of the time spent by the Minot Wrecking and Salvage Company employes in performing the above-referred-to work."

FINDINGS: The disposition of this sandhouse was in accord with the
established practice of disposing of obsolete buildings. When ownership of
the building passed from the Company, the work thereon was no longer compre
hended by the agreement, because it was no longer work performed by or on
behalf of the Company.

AWARD: Claim denied.

Dated at St. Paul, Minn., this 26th day of November, 1963.
