VS.
READING COMPANY
STATEMENT
OF CLAIM: "Claim of the General Committee of The Order of Railroad
Telegraphers on the Reading Company, that:
1.
Carrier violated and
continues to
violate the Agreement'
. between the parties when it requires or permits employes
not covered thereby to handle (receive, copy and deliver)
train orders and messages at Sixth Avenue,
Wilmington,
Delaware.
2. Carrier shall pay a day's pay (eight hours) to each of
the
following-named claimants
for each date shown after
their names: J. Gribbin - March 8, 13, 15 and 17,,1961;
and W. D. Grabey - March 6, 10, 20, 21, 22, 24, 27 and
28, 1961.
Carrier shall pay a days pay to the `senior extra idle
employee for each date the violation'occura subsequent
to the date last shown, or to regular employee on their
rest days if no extras are available, with proper claim..
ante and amounts due each to be determined by a joint
check of Carrier's time records."
FINDINGS: Elsmere Junction is the crossing point of the B and 0
main line and this Carrier=s Wilmington and Northern Branch,
located about three miles from
Wilmington, T
he`signals and .
switches were operated by Reading towermen assigned at that
point. After the B and O installed OTC and the ICC approved
Reading=s application to discontinue manual block operation,
on its branch, these positions were abolished
Prior to such abolition train orders for
Wilmington were
delivered through Elsmere Junction tower and clerks
ixi
the
Wilmington yard office phoned comiaunications to the operator
there for transmission. After the abolishment of those
positions Wilmington train orders, when necessary inter
mittently, were delivered to the train crew by telephone _;
by the operator at Montehanin, about seven miles d3stant.
The messages originated at the yard office were phoned to,.
the operator at CV for transmission . .. .,',

The fact that the operators now handling the train ·~::
orders snd messages are located a little further from
Wilmington than Elsmere Junction does not justify the
claim. Otherwise the work is handled in a similar manner_
