Brotherhood of Maintenance of Way Employees and New Jersey. Transit Rail Operation, Inc.

Claimant's suspension must be set aside, his record cleared of the October 5, 1983 charges and he be compensated for any time lost because of the suspension which was imposed on him on December 1, 1983.

Claimant was suspended for 30 days for leaving his work site 30 minutes before quitting time. The evidence supports, and we accept, Carrier's finding that claimant did leave the site 30 minutes early without permission. No valid explanation for that serious misconduct is set forth in this record. There is no basis for setting aside the discipline

that Carrier considers appropriate in this situation.
