 STATEMENT OF CLAIM:

Claim of the Brotherhood (BMWE-87-12-F12 and BMWE-8713-F12) that:


The Authority has violated Article 5, Section 514(d), of the Schedule Agreement, when assigning junior employees J. Fickley, F. Mattox, and R. Delarso, R. Canada, and V. Endeik to work overtime guarding the track equipment at Wissahickon Station on September 1, 2, 3, 8, and 9, 1987, instead of assigning Track General Helper W'Lerch, who was the senior employee and had been assigned to work with that equipment and was available and qualified on each date.


REMEDY:

Claimant Lerch shall be paid forty (40) hours at the appropriate overtime rate of pay for Authority's violation of the Agreement.

OPINION OF THE BOARD
 The Board was advised at the scheduled hearing in this matter that the claim was withdrawn, without prejudice.
