STATEMENT OF CLAIM:
Appeal of dismissal assessed J. H. Hall on
July 18, 1991, in connection with being charged
with being absent without permission, failure to
notify supervisor, conduct unbecoming a Conrail
employee by bringing unauthorized person into
camp cars on June 5, 1991, discharging a .25
caliber hand gun several times resulting in his
arrest and incarceration and violation of NORAC
Rule D and Safety Rules 3013 and 3014.
Upon the whole record and all the evidence, after
hearing, the Board finds that the parties herein are
carrier and employee within the meaning of the Railway
Labor Act, as amended, and this Board is duly
constituted by agreement under Public Law 89-456 and
has jurisdiction of the parties and subject matter.
