STATEMENT
OF CLAIM:
1. Carrier violated the agreement between the parties hereto when on
April 1, 1958, and subsequent dates, it caused, required and permitted
employes not covered by the Telegraphers' Agreement to handle, receive,
copy and deliver track car line ups (Forms 1089-D) over the telephone
at Okonoko Station, Maryland, which work was and is reserved solely to
employes covered by the Telegraphers' Agreement.
2. Carrier be required to compensate an idle operator, extra in preference, pay for one day on April 1, 1958, and pay for one day (8 hours)
on all subsequent dates on which similar violations occur at.Okonoko
Station.
FINDINGS:
The track car lineup here involved was copied at Okonoko Station, located
2,554 feet west of the former tower at Okonoko.
An operator was never employed at Okonoko "station", and from the track
facilities information available to this Board, we cannot find any evidence to
sustain a finding that this point (Okonoko "station") is within the "station
limits" of the former tower at Okonoko.
